This Prohibited Use Policy (this "Policy") sets out which uses of the Service are not permitted. It supplements the Terms and Conditions (the "Terms") of BEK Service GmbH ("Famulor," "we," or "us") and forms an integral part of them. In particular, it specifies Sections 7 and 8 of the Terms. Capitalized terms have the meaning given to them in the Terms.
This Policy applies to every use of the Service, in particular AI voice agents, inbound and outbound calls, campaigns, messages (e.g., SMS, WhatsApp, and email), voice clones, knowledge bases, integrations, the API, and the MCP server. It applies to you, to everyone who uses the Service through your account and, if you make the Service available to your own clients (e.g., under a white-label or agency plan), to those clients. You are responsible for ensuring that your agents, content, campaigns, and integrations comply with this Policy, regardless of whether they were created by you, your team, your clients, or with the help of AI. Your obligations under applicable law and the Terms remain unaffected.
In short: Use Famulor for lawful, honest conversations. Obtain the required consent before you call or message anyone, make clear that an AI is speaking, clone voices only with permission, and never use Famulor to deceive, harass, or endanger people. This summary is for orientation only; the following sections are binding.
1. Protecting children
You must not use the Service to:
- Sexual abuse of children: create, store, transmit, or promote content that sexualizes minors or that facilitates the sexual abuse or exploitation of children, including grooming. We report such content to the competent authorities;
- Harm to minors: bully, threaten, humiliate, or harass minors, or expose them to content unsuitable for their age, such as pornography or graphic violence;
- Advertising to minors: place advertising calls or send advertising messages to people you know or should know are minors;
- Children's data: process personal data of children without the consent of a parent or guardian where the law requires it.
2. Unlawful activities
You must not use the Service to:
- Violations of law: engage in, prepare, promote, or facilitate activities that violate applicable law, in particular criminal, consumer protection, competition, telecommunications, or data protection law;
- Illegal goods and services: offer, arrange, or advertise illegal goods or services, such as illegal drugs, unlawfully traded weapons or explosives, counterfeit goods, stolen data, or human trafficking;
- Third-party rights: violate intellectual property rights (e.g., by using music, recordings, texts, or trademarks without a license), personality rights (e.g., the right to one's own voice, name, or image), or the privacy rights of others;
- Unlawful data processing: use personal data without a legal basis, e.g., contact data that was obtained unlawfully, or special categories of personal data such as health data without the required legal basis;
- Sanctions: use the Service in violation of applicable sanctions or export control laws, or for or on behalf of sanctioned persons, organizations, or countries.
3. Calls and messages
Agents on Famulor talk to real people. The following rules apply to every call made and every message sent through the Service, whether by an AI agent, a campaign, a member of your team, or via the API:
- Consent and legal basis: Only call or message people if you have the consent or other legal basis required by law. Examples are the prior express consent of consumers to advertising calls under Section 7 of the German Act Against Unfair Competition (UWG), or the prior express written consent that the US Telephone Consumer Protection Act (TCPA) requires for many calls using an artificial or prerecorded voice, including AI-generated voices. Document consent as required by law (in Germany, under Section 7a UWG) and provide proof to us on request.
- Objections and opt-outs: Honor objections and opt-outs without undue delay and permanently, including when someone says during a call that they do not want to be contacted again. Your agents must be able to accept such requests. Check public do-not-call lists and Robinson lists where required.
- Calling times and frequency: Only call at times that are permitted by law and reasonable in the recipient's time zone, and do not contact people with excessive frequency. Do not use the Service to flood lines with calls ("call bombing").
- Caller ID: Always display a phone number that is assigned to you or that you are authorized to use and at which you can be reached. Do not falsify caller IDs ("spoofing"), do not suppress them for advertising calls, and do not rotate numbers to avoid blocking, spam labels, or complaints.
- Identification: In outbound calls, clearly state at the beginning on whose behalf the call is made and, for advertising calls, its commercial purpose.
- No random dialing: Do not call or message randomly generated or sequential numbers, or numbers whose origin you cannot account for.
- Emergency numbers: Do not place automated calls to emergency numbers (e.g., 110, 112, or 911) or to other emergency or crisis lines.
- Telecommunications fraud: Do not generate artificial traffic (e.g., to premium-rate or international numbers), do not place one-ring calls designed to provoke callbacks ("wangiri"), and do not otherwise abuse phone numbers or networks.
- Messages: Only send messages with the required consent, identify yourself as the sender, offer a simple way to opt out where required, and comply with the rules of the respective channel and network operators (e.g., the WhatsApp Business policies or registration requirements for business SMS such as A2P 10DLC in the US). Do not send spam or phishing messages.
- Phone numbers and registrations: Provide complete and truthful information when you obtain phone numbers, sender IDs, or regulatory registrations (e.g., KYC checks), and keep this information up to date. Do not pass on phone numbers provided by us to third parties without our consent.
4. AI transparency and recordings
- Disclosure of AI: Make sure that people know they are talking to an AI system, at the latest at the beginning of the conversation, unless this is obvious from the circumstances. This also serves to comply with the transparency obligations of the EU AI Act. Your agents must never claim to be human or deny being an AI when asked.
- Labeling of synthetic content: Where required by law, label audio and other content that was generated or manipulated with AI (e.g., deepfakes) as such.
- Recordings: Only record calls after informing all participants and obtaining any consent required by law. In Germany, for example, recording the non-public spoken word without authorization is a criminal offense (Section 201 of the German Criminal Code, StGB). Where required, also inform participants about the transcription and analysis of the call.
5. Voice clones and impersonation
You must not use the Service for:
- Cloning without consent: cloning any voice other than your own, unless the person concerned has given explicit consent to the specific use after being informed about it, documented in writing or in another durable, verifiable form. For minors, a parent or legal guardian must consent. Keep proof of consent and provide it to us on request. If consent is withdrawn, stop using the voice clone and delete it without undue delay;
- Public figures: cloning the voices of celebrities, other public figures, or deceased persons without verifiable authorization from the person or the holders of their rights. Section 7 applies to politicians;
- Impersonation: impersonating real persons, companies, public authorities, or other institutions (e.g., police, courts, tax offices, banks, or health insurers), falsely claiming to act on their behalf, or pretending to be a relative or acquaintance (e.g., "grandchild scams" or "shock calls");
- Voice authentication: using voices generated with the Service to bypass voice-based authentication or identification (e.g., voice biometrics at banks) or to gain access to accounts;
- Deepfakes: using synthetic voices to deceive, defame, harass, or sexualize real people, or to attribute statements to them that they did not make.
6. Fraud, deception, and manipulation
You must not use the Service for:
- Fraud: defrauding people, e.g., through phishing or vishing, fake prize notifications, fake invoices, fake technical support, investment or romance scams, or advance-fee fraud;
- Sensitive data: having agents request passwords, PINs, TANs, one-time codes, or complete payment card data (card number, expiry date, or security code), unless we have expressly agreed to this in writing;
- Misleading practices: deceiving people about who you are, the purpose of the call, prices, contract terms, or their rights, or concluding contracts without the information or confirmations required by law;
- Manipulation: using aggressive or manipulative techniques that impair people's ability to make free decisions, in particular by exploiting their age, illness, disability, an emergency, or economic hardship;
- Debt collection: threatening, pressuring, deceiving, or insulting debtors, contacting them at unreasonable times, or disclosing debts to third parties without authorization;
- Fake engagement: creating fake reviews, ratings, votes, or survey responses;
- Pyramid schemes: promoting pyramid schemes, snowball schemes, or similar schemes.
7. Elections and politics
- Politicians: Do not clone or imitate the voices of political candidates, office holders, or government officials, even with their consent, and do not impersonate them.
- Election integrity: Do not spread false or misleading information about elections, referendums, or voting procedures (e.g., dates, polling places, or eligibility), do not discourage anyone from voting, and do not intimidate voters.
- Political advertising: Only use the Service for political advertising, election campaigns, or political fundraising with our prior written consent and in compliance with applicable law, including the transparency rules for political advertising.
8. Harmful content
You must not use the Service to create, transmit, or promote content that:
- Violence and extremism: threatens, glorifies, or incites violence, or supports terrorist or violent extremist organizations;
- Hate: attacks, degrades, or discriminates against people on the basis of characteristics such as ethnic origin, nationality, religion or belief, disability, age, sex, gender identity, or sexual orientation;
- Harassment: harasses, bullies, intimidates, or stalks people, or exposes them (e.g., by publishing their personal data);
- Self-harm: encourages suicide, self-harm, or eating disorders;
- Dangerous instructions: provides instructions for making weapons, explosives, or other dangerous substances;
- Sexual content: is sexually explicit or offers erotic services, including adult hotlines;
- Dangerous misinformation: spreads false information that is likely to cause significant harm, e.g., about health, medical treatments, or emergencies.
Clearly recognizable training, educational, artistic, or journalistic uses may be permitted, e.g., role-plays that train your team to handle difficult calls, provided that no real person is targeted or deceived and no hatred or violence is incited. Section 1 applies without exception.
9. High-risk uses
- Medical, legal, and financial advice: Your agents must not replace qualified professionals. They must not make individual diagnoses, recommend treatments, assess medical urgency without review by qualified staff, or give individual legal, tax, or investment advice. Organizational tasks, such as scheduling appointments, providing general information, or forwarding requests to your staff, are permitted.
- Emergencies: Do not use the Service as the sole means of handling emergencies or as a substitute for emergency services. If a caller reports an emergency, your agent must refer them to the emergency services or transfer the call to a person. Section 8 of the Terms applies to applications whose failure could endanger life or health.
- Automated decisions: Do not make decisions based solely on automated processing that produce legal effects concerning people or similarly significantly affect them (e.g., on loans, insurance, employment, housing, or access to essential services), unless the law permits this and you provide the required safeguards, in particular review by a person.
- EU AI Act: Do not use the Service for practices prohibited under Article 5 of the EU AI Act, such as manipulative or deceptive techniques that cause significant harm, the exploitation of vulnerabilities, social scoring, or inferring the emotions of employees or students from their voice or other biometric data (except for medical or safety reasons). If your use falls into a high-risk category under the AI Act (e.g., screening or evaluating job applicants, or assessing creditworthiness), you must meet the obligations that apply to you as a deployer, in particular human oversight and informing the persons concerned.
- Biometrics: Do not use voice data to identify people biometrically without the explicit consent required by law, and do not use it to infer sensitive characteristics such as ethnic origin, political opinions, religious beliefs, health, or sexual orientation.
10. Restricted industries
The following uses require our prior written consent (email is sufficient):
- real-money gambling, betting, and lotteries;
- payday loans and other high-cost short-term loans, debt settlement, and credit repair services;
- the brokerage or promotion of crypto-assets or other high-risk financial products (e.g., CFDs or forex trading);
- the marketing of tobacco and nicotine products, e-cigarettes, or cannabis products;
- the trade in weapons, ammunition, or pyrotechnics, where lawful;
- crisis and counseling services for people in acute distress (e.g., suicide prevention);
- political advertising and election campaigns (see Section 7).
We may refuse consent or grant it subject to conditions.
11. Security and platform integrity
You must not engage in:
- Unauthorized access: accessing or attempting to access the Service, other customers' accounts or data, or third-party systems without authorization, or testing the Service for vulnerabilities without our prior written consent. If you discover a vulnerability, report it to us confidentially at support@famulor.io;
- Malware and surveillance: distributing malware or using the Service for the covert surveillance, eavesdropping, or tracking of people;
- Circumvention: circumventing or manipulating usage limits, outbound limits, rate limits, verification or review processes, safety filters, or other protective measures, including through prompt injection or jailbreaks;
- Overload: placing an excessive or unusual load on the Service or its infrastructure, or interfering with its operation;
- Data extraction and reverse engineering: systematically extracting content or data from the Service other than through the API and documented interfaces, or decompiling or reverse engineering the Service, except where mandatory law permits this;
- Misuse of accounts and billing: sharing login credentials or API keys outside your organization, using other people's accounts without authorization, creating multiple accounts to obtain free credits, trial periods, or referral or partner commissions, manipulating usage, credits, or billing, or using payment methods without authorization;
- AI training: using audio generated through the Service, in particular synthetic voices, to train, fine-tune, or evaluate AI models for speech synthesis or voice cloning, or systematically extracting non-public components of the Service (e.g., prompts or templates) to develop a competing product;
- Misuse of our brand: using our name, logos, or trademarks in a misleading way, or creating the impression that Famulor endorses your offering. White-label partners may remove Famulor branding to the extent their plan permits.
12. Resellers, agencies, and white-label partners
If you make the Service available to third parties, e.g., under a white-label or agency plan or through the API, you must:
- contractually bind your clients to this Policy or to rules that are at least as strict;
- check your clients' use cases for plausibility, act on violations without undue delay, and cooperate with us;
- on request, tell us which client is responsible for a specific agent, phone number, campaign, or content, and provide us with relevant evidence (e.g., proof of consent), to the extent legally permissible.
You are responsible for your clients' use of the Service as for your own (Section 5.2 of the Terms).
13. Third-party providers
Some features use AI models as well as voice, telephony, and messaging services from third-party providers. If a use violates the usage rules of such a provider, we may restrict the affected feature for you, even if this use is not expressly listed in this Policy. We will inform you of any such restriction.
14. Enforcement
- Review: We may investigate suspected violations. To do so, we may review relevant account data, agent configurations, content, and usage data to the extent necessary and in compliance with data protection law, and ask you for information and evidence (e.g., proof of consent). We use automated systems and manual reviews to detect violations. For example, we automatically check the instructions and greetings of AI agents when they are saved and may block an agent if we detect a serious risk, such as impersonation, caller ID spoofing, fraud, or a missing AI disclosure. We also review requests for higher outbound limits.
- Measures: Depending on the severity of the violation, we may warn you, require you to remedy the violation, remove or disable content, agents, or phone numbers, pause campaigns, reduce limits, restrict features, temporarily suspend your account, or terminate the contract for good cause (Sections 3.3, 12.2, and 12.4 of the Terms). We choose measures that are proportionate to the violation.
- Urgent cases: In the event of ongoing fraud, a danger to people, or serious harm to phone numbers, networks, or our providers, we may act immediately and without prior notice.
- Information: We will inform you of measures and the reasons for them, unless we are prohibited from doing so by law or by an order of an authority. In urgent cases, we will do so without undue delay after the fact.
- Cooperation with authorities: Where legally permitted or required, we report violations to the competent authorities and cooperate with authorities and network operators, e.g., when tracing unlawful calls.
- Damages: To the extent you are responsible for a violation, you will compensate us for the resulting damage, including charges and contractual penalties imposed on us by network operators or other providers as a result. Further claims remain unaffected.
- No waiver: If we do not act on a violation in an individual case, this does not constitute a waiver of our rights.
15. Reporting violations
Anyone, including people who received a call or message made through Famulor, can report suspected violations of this Policy or content they consider unlawful. Send your report to support@famulor.io with the subject "Abuse report" and include, where possible:
- the phone number or sender that contacted you, and the number that was called or messaged;
- the date, time, and time zone of the call or message;
- a description of what happened and why you consider it unlawful or a violation of this Policy;
- screenshots or other evidence, if available;
- your name and email address so that we can contact you. You can report content that sexualizes children without giving your name.
We confirm receipt of reports that include contact details, review them carefully and objectively, and inform you of our decision. We share information about our customers only to the extent permitted by law.
If you received an unwanted call, you can tell the agent that you do not want to be contacted again. You can also report unwanted advertising calls to the competent authority in your country, in Germany to the Federal Network Agency (Bundesnetzagentur).
16. Complaints about our decisions
If you believe that we have wrongly taken action against your account, your content, or your use of the Service, or if you disagree with our decision on a report, contact us at support@famulor.io and explain why. If our automated review has blocked an AI agent, you can also request a manual review directly in the editor of the affected agent, via the API, or via the MCP server. We will review the case and inform you of the result. If a measure turns out to be unjustified, we will reverse it without undue delay. Your statutory rights, including the right to take legal action, remain unaffected.
17. Changes to this Policy
We may update this Policy, for example to reflect new legal requirements, rules of our providers, or new features. We will announce material changes in advance in accordance with Section 1.3 of the Terms. The current version is always available at https://www.famulor.io/use-policy.
18. Language and contact
This Policy is available in German, English, Spanish, French, and Dutch. In the event of discrepancies, the German version prevails for customers with their registered office in Germany, and the English version prevails for all other customers.
